Euro Tunnel
SRSL is engaged in the provision of insurance-based risk management solutions to Euro Tunnel – a bi-national (Anglo-French company), which is responsible for the management and operation of the Channel Tunnel until December 2086.
Euro Tunnel is responsible for managing the tunnels, terminals and tracks between Folkstone, Kent and Coquelles near Calais. Consequently, the company requires the highest level of safety, security, environmental protection and corporate governance.
SRSL has completed the implementation of a tailor-made risk management strategy to meet the insurance needs to Euro Tunnel. The Euro Tunnel operation involves a massive and complex infrastructure. Every day, an average of 400 trains and shuttles travel through the Channel Tunnel, carrying some 40,000 people, 7,000 cars and 3,500 trucks. This further highlights the importance of a detailed risk management strategy, which took into account British and European safety, transport and environmental issues.
Swiss RE Tower
When the Swiss Reinsurance Company decided to change its headquarters to a striking building named the Swiss RE Tower, SRSL was
instructed to handle the insurance management of the development. The building is approximately 500,000 square feet (making it the second highest structure in this area of town) and is located in the heart of the City on the site where the Baltic exchange building used to stand. With its distinctive “gherkin” shaped form and 40-storey height, it stands out as an icon from the cluster of buildings that make up London’s financial centre.
The service provided by SRSL included quarterly site visits, drafting detailed reports and issuing/following through risk recommendations. This formed part of the insurance programme devised for the client.
Heathrow Terminal 5
On November 2001, the Government announced its decision to approve the building of Heathrow’s Terminal 5. T5 will allow Heathrow to maintain its position as Europe’s leading international airport and provide much needed state-of-the-art facilities to help meet the future demand to fly.
SRSL was responsible for the insurance-based risk
management of the T5 tunnelling phase – one of the largest construction projects in the UK. It is a huge and complex construction programme, phase 1 alone consists of 16 major interconnecting projects and 134 sub-projects. SRSL was instructed to risk manage the insurance programme for the T5 construction. This involves quarterly site visits, drafting detailed reports and issuing/following though on any risk recommendations.
The T5 project includes:

two satellites (one in phase2)
Channel Tunnel Rail Link (CTRL) project
The Channel Tunnel Rail Link (CTRL) project is a public-private partnership, which has been set up to build a rail link from St Pancras London to the Channel Tunnel. The phased construction of CTRL began in October 1998 with the start of work on section one. Section one will run between the Channel Tunnel and Fawkham Junction in north Kent and is on schedule for completion in October 2003. Work on section two began in July 2001 and will complete the UK’s first high-speed line into central London by the end of 2006.
SRSL has been employed to handle the insurance risk-based management of the project. A number of issues have arisen, which required his expertise. SRSL has been involved with the area 200 contracts of the London tunnels, which includes contract 220 (Stratford railway to London West Portal – 7.5kms) and contract 240 (Stratford railway to Barrington Road, Ilford – 4.7kms). The intricate nature of the work being carried out, coupled with the high-risk element of the construction work requires a thorough risk management assessment and strategy.
The contracts with which SRSL has been involved are complex – contract 220 involves the excavation of the vent shaft at Corsica Street. Both tunnel-boring machines have launched from the Stratford Box and are making good progress towards St Pancras. Contract 240 involves the construction of the vent shafts at Barrington Road and Woodgrange Road.

Challenges for 2007 and beyond
Workplace stress
10 million days were lost in 2006 due to stress, despite a fall of 20%, according to latest HSC figures. Lisa Fowlie of IOSH said that “stress is still misunderstood and employers have to do more to prevent it”. Research by Affinity Health at Work has drawn up a list of 19 “stress management behaviours” for bosses of which easy-going, funny, consistency and being generous are a few.
UK H&S laws “correctly applied” in EU
The Advocate General has advised the European Court that the UK are correctly applying the Health and Safety at Work Directive ahead of their final ruling this year.
Hand Tool Vibration Emission Values Inaccurate!
Only 1 in 5 hand tool manufacturers’ declared single axis vibration emission values reflect the upper quartile vibrations seen in use. Triaxial measurements can be 56% higher than declared values, according to the HSL, who recommend changes to standards and a revision of the test code following further research.
Manslaughter Bill ‘No Teeth’ for Big Businesses
Legal experts warned that the current wording of the manslaughter bill would make it difficult to prove that ‘senior managers’ in large organisations have a ’significant role’ in safety and may be able to delegate safety to a non ‘senior’ role.
Too few reporting on H&S in annual reports
Only a quarter of companies in the FTSE250 and FTSE100, compared to 84% of FTSE350 companies, report on health and safety issues in their annual reports according to System Concepts Ltd. H&S principles and RIDDOR were most often reported but only 9% had any H&S targets.
News Snippets
Out of nearly 150,000 motorists tested over the Christmas period nearly 7% proved positive for alcohol.
A quarter of businesses fail to train their staff in safe use of fork-lift trucks and too many injuries are caused by reversing vehicles. The HSE stated that “if a company has a H&S policy on vehicles it must be implemented”.
Several people were injured when chemicals were released at Seal Sands, Teesside.
The HSE has issued a technical alert for the correct installation and pre-loading of high tensile bolts on Tower Cranes.
New Regulations & Guidance
Smoking ban - ‘enclosed premises’ definition
The definition of a ‘substantially enclosed’ premise has been clarified as premises with a ‘ceiling or roof and less than half of their perimeter consisting of openings in the walls other than, windows, doors or openings which can be shut.’
WEEE regulations published
New rules for dealing with waste electrical and electronic equipment (WEEE) require manufacturers, importers and rebranders to join a compliance scheme by 15/3/07 and producers would be required to meet the cost of dealing with waste products from next July.
New CDM regs require timely appointments
CDM 2007 R14 requires that the project client must appoint a CDM co-ordinator (who replaces the role of a planning supervisor) “as soon as practicable after initial design work or other preparation for construction has begun”. Designers, principle contractors, contractors and co-ordinators are now also responsible for informing the client of his duties under CDM 2007.
RoSPA in-vehicle technology guidance
A new guidance document produced by RoSPA entitled Driving for Work: Vehicle Technology provides advice on how employers and line managers can introduce policies to ensure that the benefits and risks of vehicles fitted with new technology such as Satellite Navigation, telematics, tyre pressure monitoring and adaptive cruise control etc are assessed and staff are educated and trained in its safe use. A sample policy is also provided.
What’s in the courts?
Lightwater Valley theme park and ride manufacturers were fined, in January, a total of £157,500 when a 20 year old woman died and three others injured after two cars collided on the ‘Treetop Twister’ roller coaster back in 2001.
Rosekey Ltd and a Director were fined £90,000 each and ordered to pay compensation after a trench undermined the foundations of a building causing it to partially collapse.
A scaffolder, who was 50% to blame, has won a ‘substantial’ six figure sum after falling out of a bunk bed on a North Sea oil rig when the ladder was not fixed properly.
Corus has been ordered to pay £3m following an explosion at its Port Talbut plant which killed 3 people.

Health and safety activity has a positive effect on economic performance according to paper RR510 by Cambridge Econometrics commissioned by the HSE.
Also, case studies by the HSE, on corporate responsibility, further highlight the benefits of effective health and safety leadership and ‘corporate governance’.
Health and safety laws ‘save over 5,000 lives’
More than 5,000 lives have been saved since the introduction of HASAW in 1974 according to official figures. Lord Hunt, minister for health and safety was “delighted”. Britain now has the lowest rate of workplace fatalities in Europe.
Smaller contractors ‘have 75% of fatal injuries’
“The gap in safety performance between larger and smaller contractors is increasingly getting bigger”, according to HSE Chief Inspector for Construction. Up from 65% last year, with lifting operations, mobile plant and working platforms a concern.
Business continuity standard
A new business continuity standard has been published by BSI as BS25999, and hailed as an important step towards protection from corporate disasters.

Young people at work
Young people are 50% more likely to have non-fatal accidents at work. Employers are urged to pay particular attention to the young in their health and safety management systems and below the age of 18 this is a statutory requirement with special risk assessments and increased supervision called for.
Food safety crack down ‘fails to cut poisonings’
Up to 80,000 people are still being poisoned each year with 50% occurring in restaurants and 20% in schools, hospitals and care institutions.
Smoke, fumes & dust are UK’s fifth biggest killer
30,000 deaths occur each year from chronic obstructive pulmonary disease (COPD) caused by smoke, fumes and dust.
Junk food ‘putting road-users in danger’
Bad eating habits are leaving motorists feeling “sluggish at the wheel” and a threat to road safety according to a new report by the RAC.

HSC approves new CDM Regs due April 2007
The HSC met on 17/10/2006 and approved the revised construction (Design and Management) Regulations and Approved Code of Practice (ACoP), which will be available from January 2007 with the regulations due in April 2007.
Control of Asbestos Regulations 2006
New regulations came in to force on 13 November 2006 as SI 2006/2737 and bring together the three previous regulations.
Road safety bill gains Royal assent
The Road Safety Bill was finally passed on 8/11/2006 and will become law next year with causing death by careless driving and causing death by driving while unlicensed, disqualified or uninsured carrying custodial sentences.
New offence of using unlicensed labour
A new law came in to force on 1/12/2006 making it an offence to use an unlicensed labour provider in the agriculture and food industries.
What’s in the courts?
Falling timber shutter killed workman - two companies were fined £350,000.
Scaffold tower collapsed due to overload causing workmen to fall 5m. Two firms were fined £132,000 for failing to design and control properly.
Power company fined £400,000 after a fatal accident for failing to protect a worker from a 5,500 volt electric shock.
Dumper trucks overturning - two separate incidents resulting in a death and a leg amputation were fined £250,000 and £9,334 respectively.
Lorry grab strikes overhead power line - both company and director were fined £80,000 and £35,000 costs.
An unprotected edge during maintenance work lead to a 5m fatal fall and fines of £300,000.
Unsafe system and unsuitable poorly maintained and not properly used fall arrest equipment failed to protect worker from fall from roof tank.
£25 ladder solution could have prevented a fall causing a “horrendous heal injury” and costing a fencing company £3,700.

Top 5 Fatal Injury Categories
The fatal injuries in construction that have occurred since 1 April 2006 have included the following categories in descending order of frequency:
Falls from height - including falls through fibre cement roofs and scaffold towers;
Lifting operations - involving cranes during timber frame erection, demolition and plant construction;
Electrocution - mainly through contact with overhead powerlines and refurbishing domestic premises;
Mobile plant - excavators and telehandlers overturning and reversing;
Collapse of structures - from scaffolding and walls collapsing mainly on domestic premises.
Slips, Trips & Falls (STFs) Research
New research shows that a good moral attitude, as well as addressing the physical environment, can help in reducing STFs. The biggest influences are; good housekeeping, top management and supervisory commitment and fair and consistent reward systems. Positive behavioural change is also more likely if the underlying attitudes are addressed through appropriate risk communication.
HSE Campaigns & Safety Alerts
The HSE have launched a number of campaigns and safety alerts recently:
‘Better Backs’ Campaign Underway
With over 2 million British workers suffer work related ill health with Musculoskeletal disorders by far the largest causation, the HSE re-launched their ‘Better Backs’ campaign on 16th October. Advice on safe handling is available at www.hse.gov.uk.
Asbestos - Don’t take the gamble
With 3500 deaths per year, Asbestos is the UK’s biggest work related killer. Plumbers, carpenters and builders etc may be at risk, with buildings constructed before 2000 being the main threat. The HSE has launched a ‘one stop shop’ asbestos website at www.hse.gov.uk/asbestos to provide help and advice, including an 8 step plan to asbestos risk management.
Tower Cranes
The HSE have issues a safety alert to the construction industry reminding them of the importance of the safe erection, operation, maintenance and dismantling of tower cranes following a number of serious incidents recently.
New Regulations & Guidance
EU Case against UK ‘Reasonably Practicable’ wording
A European court case has been brought against the UK because the wording “so far as is reasonably practicable” allows for consideration of the financial cost to the employer. A final judgment is not due until 2007.
Regulatory Reform (Fire safety) Order
The new Regulatory Reform (Fire Safety) Order 2005 came in to force on 1st October 2006 and provides; one standard, requirement of a ‘responsible person’ and is risk assessment based.
Age Discrimination
The Employment Equality (Age) Regulations came in to force on 1st October 2006 and aims to address ‘ageism’ said to be rife within the UK, affecting younger people as well as older employees. Age related unequal pay, promotion and ‘similar age teams’ practices are no longer acceptable.
New CDM Regs due April 2007
The construction (Design and Management) Regulations 2007 will combine the existing CDM 94 and the Construction (Health Safety and Welfare) Regulations 1996 into one regulatory package and be supported by an Approved Code of Practice (ACoP). The ACoP will be available from January 2007 to allow time for the changes to be implemented.
What’s in the courts?
Mixing paddles - Wembley stadium contractor was fined £3,000 and costs of 3,028 when an 18 yr old worker suffered partial amputation of 3 fingers, when a safety grill was removed and the interlock switch disabled to mixing paddles.
Cement burns - a contractor was fined £15,000 and costs of £7,000 after a plasterer suffered cement burns after kneeling in wet cement with no kneepads or non-permeable clothing.
Electrocution burns - a demolition contractor was fined £10,000 with costs of £6, 659 for failing to protect a worker when his vehicle tipper bed came in contact with overhead power lines.
Other cases include - fractured ankle due to fall from unguarded working platform, 8m fall to death through fragile roof, crushed legs due to reversing vehicle and two incidents involving untrained staff using fork lift trucks.

Latest HSE statistics
Latest statistics shows fatal injuries are at record low levels with 212 fatalities in 2004/5 down from 223 the previous year.
Construction and agriculture, which account for about half of all fatalities, are down by 14% and 21% respectively. At 1.1 workers per 100,000, Britain has now the lowest fatal injury rate in Europe.
The latest work related ill health analysis shows no change from last year with over 2 million cases in total and 0.6 million new cases. This equates to 1.8% of the working population or 1.2 days per worker. Muscular skeletal disorders accounted for 206 thousand cases and stress, depression or anxiety 245 thousand.
Falls from height concern
In 2004/5 53 people died and nearly 3800 were seriously injured as a result of a fall from height in the workplace.
Following several recent cases the HSE has warned companies to ensure adequate precautions are being taken under The Work at Height Regulations 2005 (WAHR) and have recently completed a Height Aware campaign.
Poor scaffolding main cause
Following two major scaffolding collapses in Scotland, HSE inspectors have been carrying out random inspections on construction sites, which has revealed sub-standard scaffolds caused by lack of design and inadequate training, experience or skill.
Unannounced inspections of 61 small building sites in Bradford resulted in 4 prohibition notices and 18 stopped work to rectify problems mainly created by poor standards of scaffolding.
Good practice at Lloyd’s
Following WAHR 2005 the cleaners and maintainers of the Lloyd’s building in Lime Street, London, have added several man-safe systems to abseilers equipment, cradles and platforms. All workers are trained in working at height, with the following courses recommended for competence:

The ODPM are developing new fire safety legislation called Regulatory Reform (Fire Safety) Order due to come into force in October 2006. Key features are:

“Get a life”, says HSC
The HSC are concerned about criticisms that “health & safety is stopping people doing worthwhile and enjoyable things” and that the industry should stop concentrating on trivial risks and petty issues. It issued guidance on what sensible risk management is about and what it is not about and cutting down on red tape.
Corporate manslaughter bill
Published on 21 July 2006, the new corporate manslaughter bill makes it easier to identify the people responsible and gives powers of unlimited fines or life imprisonment.
Mobile plant warning
The HSE have drawn attention to two specific risks:
Drivers of mobile elevating working platforms are prone to being trapped against an overhead or adjacent object that prevents the controls from being released.
Limited visibility when reversing telehandlers combined with poor pedestrian segregation are causing a high number of incidents and accidents.

Construction boss Wayne Davies of A&E Buildings, was jailed for 18 months for failing to provide safe equipment for working at height - a man was killed and another seriously injured when a home-made cage and un-serviced telehandler toppled over.
Sonea (UK) Ltd were fined £70,000 with £77,046 costs after a dust explosion shattered a worker’s body at their Knowsley premises, when failure to maintain safe plant allowed smouldering material to enter and cause a fire.
Gleeson Construction Services Ltd of Sutton were fined £47,860 and costs after mortar tubs fell from a crane and landed on a worker fracturing his vertebra.

Liability Risk Management Presentations
The demand for technical presentations of the in-depth principles and techniques of risk management is increasing as both insurer and insured reap the benefits from this approach.

Sovereign Stars Win National Championships
Sovereign Risk Solution’s up and coming risk managers are also quite handy at managing risk in their chosen sport.
Mike Cooper and Ashley Cowburn, both 3rd Dans with the English Shotokan Academy, became Karate champions at the 2006 national championships. Along with another team member, Mike Carney, they resoundingly beat all comers to win the team kumite national title. Both Mike’s put in a solid performance to win their fights. In the final bout, Ashley and his opponent put on a dazzling display of the art, bringing the crowd to their feet. Whilst ahead on points, Ashley put in a blistering reverse kick to finally take the match.
Ashley also won the men’s individual kata after performing Nejushio. Mike Cooper came third in the same competition with the kata Jion.
Mike Cowburn, Director of Sovereign and team coach said “despite entering fewer competitors this year, Cleckheaton SKC achieved their highest competition success. I am particularly pleased with Mike and Ashley, who have studied karate from the age of 8 years old. This marked the coming of age of two of the UK’s brightest prospects”. And jokingly said;

SRSL Goes Olympic!
Sovereign Risk Solutions Limited (SRSL) has been appointed as part of the Liability Risk Management strategy to the Olympic Development Authority (ODA).
The ODA along with the London Organising Committee for the Olympic Games (LOCOG), chaired by Lord Coe, is responsible for delivering the 2012 Olympic and Para-Olympic games and the sustainable legacy.
Consisting of 500 acres, centred on the Lower Lea Valley, remedial works will commence September 2006 with building starting 2008 for completion 2011.
The ODA are responsible for; the Olympic park infrastructure, delivery of the venues, re-locatable arenas and broadcasting centre as well as the conversion to the legacy phase in 2013.
Mike Cowburn, Director of SRSL, says “we are delighted to be awarded this prestigious project. This is the largest park redevelopment scheme in Europe for 150 years and represents an exciting challenge in liability risk management”.
